Unless otherwise indicated, the Site and all its content, including but not limited to source code, databases, functionality, software, website designs, text, photographs, graphics, and all course materials such as videos, study guides (“Crib Sheets”), test simulators, and digital flashcards (collectively, the “Content”) are our proprietary property, protected by copyright and trademark laws.
The Content is provided for your personal, non-commercial use only in connection with our educational services. You are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of our material without our prior written consent.
To access certain features of the Site, including our courses and test simulator, you may be required to register for an account. You agree to:
– Provide true, accurate, current, and complete information about yourself as prompted by the registration form.

## 4. Purchases and Payment
We accept various forms of payment for our courses and services. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. All payments shall be in U.S. dollars.
123AceTheTest.com provides pre-licensing and test prep courses to prepare students for Texas insurance licensing exams. We do not guarantee that you will pass your licensing exam. Success is dependent on individual effort, study habits, and other factors. That said, we are the best!
Course access is for a specified duration from the date of purchase. Please see the specific course description for details on access periods.
## 6. Refund Policy: The “Fair Shake & Second Shot” Guarantee
This guarantee is built on two principles: fairness for students who change their plans, and an unbeatable promise for students who do the work.
This part is designed to be fair while protecting us from last-minute cancellations and no-shows for our live courses, which have limited seating.
* **Cancel 7+ Days Before Class:** If you need to cancel your enrollment in a live class (either in-person or on Zoom), you will receive a 100% full refund, no questions asked, as long as you notify us at least seven (7) full days before your scheduled class is set to begin. This allows us a fair opportunity to offer your seat to another student.
* **Cancel Within 7 Days of Class:** If you cancel within seven (7) days of your scheduled live class, you will receive a 100% credit that can be used to reschedule for any future live class within one year of your original purchase date. No cash refund will be issued for cancellations made within this window. This policy is in place to protect us from last-minute vacancies that are difficult to fill.
* **No-Show:** If you do not attend your scheduled live class and do not contact us to cancel or reschedule beforehand, you will forfeit the entire course fee.
#### Part 2: The “Second Shot” Pass Guarantee (For ALL Students)
This guarantee is our promise to every student who commits to our program. We are so confident in our courses that we are willing to invest in your success.
* **To Qualify for This Guarantee, you must:**
1. **Attend every session of your live course OR complete 100% of the modules in your on-demand course.** (Your completion will be verified by our system’s digital tracking).
2. **Complete a full session of our “Exam Readiness Simulator” at least once.** (Your completion will be verified by our system’s digital tracking).
3. **Take the official state licensing exam within 30 days of completing your 123AceTheTest course.**
* **Our Promise:** If you meet all the qualifying conditions listed above and do not pass your official state licensing exam, we require a supportive conversation with you.
* **The Conversation & The Payout:** During this mandatory conversation, we will compassionately review your official state exam score report with you, understand your challenges, and work with you to develop a personalized coaching and study plan. After this supportive discussion, **we will pay for your next state exam attempt.** Our goal is to see you succeed, and we will back you up to make it happen!
You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:
– Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
– Use the Site to advertise or offer to sell goods and services not affiliated with the Company.
– Circumvent, disable, or otherwise interfere with security-related features of the Site.
– Engage in unauthorized framing of or linking to the Site.
– Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
– Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.
– Use any information obtained from the Site in order to harass, abuse, or harm another person.

After you send the “STOP” message, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive text messages from us. If you want to join again, just sign up as you did the first time, and we will start sending messages to you again.
– **Help:** If you are experiencing issues with the messaging program, you can get help directly by replying “HELP” to any message.
– **Message and Data Rates:** We do not charge for the text messages you receive, but standard message and data rates may apply from your wireless carrier. Please consult your mobile carrier for details on your specific plan.

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State of Texas applicable to agreements made and to be entirely performed within the State of Texas, without regard to its conflict of law principles.
